Are legislatures able to form and act on intentions? The question matters because the interpretation of statutes is often thought to centre on the intention of the legislature and because the way in which the legislature acts is relevant to the authority it does or should enjoy. Many scholars argue that legislative intent is a fiction: the legislative assembly is a large, diverse group rather than a single person and it seems a mystery how the intentions of the individual legislators might somehow add up to a coherent group intention. This book argues that in enacting a statute the well-formed legislature forms and acts on a detailed intention, which is the legislative intent. The foundation of the argument is an analysis of how the members of purposive groups act together by way of common plans, sometimes forming complex group agents. The book extends this analysis to the legislature, considering what it is to legislate and how members of the assembly cooperate to legislate. The book argues that to legislate is to choose to change the law for some reason: the well-formed legislature has the capacity to consider what should be done and to act to that end. This argument is supported by reflection on the centrality of intention to the nature of language use. The book then explains in detail how members of the assembly form and act on joint intentions, which do not reduce to the intentions of each member, before outlining some implications of this account for the practice of statutory interpretation. Developing a robust account of the nature and importance of legislative intention, the book represents a significant contribution to the literature on deliberative democracy that will be of interest to all those thinking about legal interpretation and constitutional theory.

This edited collection is designed to explore the ethical nature of judicial decision-making, particularly relating to cases in the health/medical sphere, where judges are often called upon to issue rulings on questions containing an explicit ethical component. However, judges do not receive any specific training in ethical decision-making, and often disown any place for ethics in their decision-making. Consequently, decisions made by judges do not present consistent or robust ethical theory, even when cases appear to rely on moral claims. The project explores this dichotomy by imagining a world in which decisions by judges have to be ethically as well as legally valid. Nine specific cases are reinterpreted in light of that requirement by leading academics in the fields of medical law and bioethics. Two judgments are written in each case, allowing for different views to be presented. Two commentaries - one ethical and one legal - then explore the ramifications of the ethical judgments and provide an opportunity to explore the two judgments from additional ethical and legal perspectives. These four different approaches to each judgment allow for a rich and varied critique of the decisions and ethical theories and issues at play in each case.

To become law a Bill had to pass many different stages, at any of which, up to and including royal assent, it might fail; Bills unpassed at the dissolution of a Parliament were also automatically abandoned: Between 1660 and 1800 Parliament passed 14;216 Acts. In this period 7025 attempts to pass an act at Westminster failed. Failed Legislation, 1660-1800, provides a full list of these for the first time. It provides an essential perspective on the legislative history of the period and will be an essential tool for social, economic and political historians. Arranged chronologically, by parliamentary session, it presents the key information as to how legislative initiatives were handled. By showing patterns of demand for legislation, and categorising types of legislation and their success rate, it also reflects on many aspects of British history in this period, and not just political history. Subject coding allows the list to be analysed at a number of levels, from the general to the particular, including the examination of specific issues. Taken as a whole, it shows how extensively statute was used to address a very wide range of issues, both local and national, in the early modern period.

In this comprehensive, wide-ranging analysis, Susan Lehrer investigates the origins of protective labor legislation for women, exposing the social forces that contributed to its passage and the often contradictory effects it had on those it was designed to protect. A rapidly expanding female work force is prompting both employers and society to rethink attitudes and policies toward working women. Lehrer provides critical insight into current issues affecting female employees—pay equity, equal rights, maternity—that have their roots in past debates about and present realities affecting women workers. Protective labor laws enacted from 1905 to 1925 had the effect of delimiting the position of working women. Lehrer examines the relationship between women’s work in the labor force and domestic labor, and the reasons why the government was interested in regulating this relationship. Focusing on the dual need for a continuing labor force (women as producers of children) and cheap labor (women in low-paying jobs), she demonstrates the way in which social reforms worked to the advantage of capitalism even though they materially aided subordinate classes.
